Terms & Conditions • Effective Date: 2026
Section One — Acceptance of These Terms
These Terms & Conditions govern access to and use of bicepbuddies.com (the Journal), a health and wellness publication operated under the trade name Bicep Buddies, including its articles, newsletter, and paid membership. By using the Journal, subscribing to its emails, or joining the membership, an Enrollee agrees to these Terms and to the Privacy Policy, which is incorporated by reference. Anyone who does not agree should not use the Journal. Bicep Buddies operates the Journal as a trade name and does not disclose a separate legal entity or physical address through the Journal.
Section Two — Eligibility
The Journal is intended for persons who are at least 18 years old and able to form a binding contract. By using the Journal, an Enrollee represents that they meet these requirements.
Section Three — Editorial Content; No Professional or Medical Advice
The Journal publishes general health, wellness, and lifestyle information, including articles, recipes, and news, some of which may be adapted or republished from other sources. This content is for general informational and educational purposes and reflects the views of its authors. It is not professional advice, and using the Journal does not create any professional or care relationship.
THE CONTENT ON THE JOURNAL IS FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND IS NOT MEDICAL, HEALTH, OR MENTAL-HEALTH ADVICE AND IS NOT A SUBSTITUTE FOR PROFESSIONAL DIAGNOSIS OR TREATMENT. ALWAYS SEEK THE ADVICE OF A PHYSICIAN OR QUALIFIED HEALTH PROVIDER WITH ANY QUESTION ABOUT A MEDICAL CONDITION, DIET, OR TREATMENT, AND NEVER DISREGARD OR DELAY SEEKING IT BECAUSE OF SOMETHING READ ON THE JOURNAL. IN A MEDICAL EMERGENCY CALL 911 OR YOUR LOCAL EMERGENCY NUMBER; IF YOU ARE IN MENTAL-HEALTH CRISIS, CALL OR TEXT 988 (U.S. SUICIDE AND CRISIS LIFELINE).
Section Four — Membership Accounts
The paid membership requires an account. An Enrollee agrees to provide accurate information, to keep their password secure, and to be responsible for all activity under their account. Accounts are personal and may not be shared, sold, or transferred. An Enrollee must notify Bicep Buddies promptly of any unauthorized use. Bicep Buddies may suspend or close an account that violates these Terms or is used unlawfully.
Section Five — Membership, Billing, and Auto-Renewal
The paid membership is a subscription that automatically renews for successive billing periods until cancelled. By joining, an Enrollee authorizes Bicep Buddies, through its third-party payment processor, to charge the then-current fee to the payment method on file at the start of each period, plus any applicable taxes. Prices are shown at the point of purchase and may change; notice of a price change will be given before it applies, and continued membership after that constitutes acceptance. An Enrollee may cancel at any time from their account; cancellation stops future renewals and takes effect at the end of the current paid period, during which access continues.
Section Six — No Refunds
Because the membership gives immediate access to digital content, all charges are final and no refunds or credits are provided for any partial period, except where a refund is required by applicable law. Cancelling stops future charges but does not refund the current or any past billing period (see Section Five).
Section Seven — Access and License to Content
Subject to these Terms, an Enrollee is granted a limited, personal, non-exclusive, non-transferable, revocable license to access and view content on the Journal for their own, non-commercial use; premium content is available only while a membership is active. An Enrollee may not copy, reproduce, republish, redistribute, sell, sublicense, deep-link to, frame, or create derivative works from any content except as these Terms expressly allow or applicable law permits.
Section Eight — Email Program and Consent
By subscribing, an Enrollee consents to receive the newsletter and related messages from Bicep Buddies and its marketing affiliates, and may withdraw consent at any time using the unsubscribe link in any email, as described in the Privacy Policy.
Section Nine — Intellectual Property
The Journal and its contents, including text, graphics, logos, layout, and the trade name Bicep Buddies, are owned by or licensed to the operator of the Journal and are protected by intellectual-property laws. Nothing in these Terms transfers any ownership. Where the Journal republishes third-party material, that material remains the property of its owner and is used under permission or applicable law.
Section Ten — Acceptable Use
An Enrollee agrees not to:
- use the Journal for any unlawful purpose or in violation of these Terms;
- share membership credentials or give others access to premium content;
- copy, scrape, harvest, deep-link, or redistribute content except as expressly permitted;
- attempt to gain unauthorized access to the Journal or interfere with its operation; or
- submit false information or impersonate any person.
Section Eleven — Third-Party Links and Advertisements
The Journal may contain links to third-party websites and may display advertisements and affiliate offers. Bicep Buddies does not control and is not responsible for the content, products, services, or practices of any third party or advertiser, and an Enrollee deals with them at their own risk and subject to their terms. The presence of an advertisement or link is not an endorsement.
Section Twelve — Disclaimer of Warranties
THE JOURNAL AND ALL CONTENT AND MEMBERSHIP FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NO WARRANTY IS MADE THAT THE JOURNAL WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
Section Thirteen — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE BICEP BUDDIES PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE JOURNAL OR ANY CONTENT, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL AGGREGATE LIABILITY OF THE BICEP BUDDIES PARTIES FOR ALL CLAIMS RELATING TO THE JOURNAL WILL NOT EXCEED THE GREATER OF THE AMOUNT THE ENROLLEE PAID TO BICEP BUDDIES IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to a particular Enrollee; in that case, liability is limited to the greatest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law.
Section Fourteen — Indemnification
An Enrollee agrees to indemnify, defend, and hold harmless the Bicep Buddies Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with the Enrollee’s use of the Journal, violation of these Terms, or infringement of any third-party right.
Section Fifteen — Dispute Resolution and Binding Arbitration
Informal Resolution. Before starting any formal proceeding, an Enrollee agrees to first contact Bicep Buddies at the address below and to try in good faith to resolve the dispute informally for at least thirty (30) days.
Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to the Journal or these Terms that is not resolved informally will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted remotely by videoconference where possible, or otherwise in the United States. Judgment on the award may be entered in any court of competent jurisdiction.
Exceptions. Either party may bring an individual claim in small-claims court, and Bicep Buddies may seek injunctive relief in court to protect its intellectual property or stop unauthorized access. These matters are not subject to arbitration.
Class-Action Waiver. All disputes will be resolved on an individual basis. An Enrollee and Bicep Buddies each waive any right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is found unenforceable as to any claim, that claim will proceed in court rather than in arbitration.
Opt-Out. An Enrollee may opt out of this arbitration agreement by sending written notice to the contact email below within thirty (30) days of first accepting these Terms. A valid opt-out does not affect any other provision.
Section Sixteen — Governing Law and Jurisdiction
These Terms and any dispute arising under them are governed by the federal laws of the United States, without regard to conflict-of-laws principles. To the extent any matter is not subject to arbitration as described above, it will be brought exclusively in the competent federal courts of the United States, and each Enrollee consents to the jurisdiction of those courts.
Section Seventeen — Changes to These Terms
These Terms may be updated from time to time. The revised version will be posted at bicepbuddies.com with a new effective date, and the updated terms apply from the date of posting. For material changes affecting a membership, notice will be given before the next renewal. Continued use after a change means the change is accepted.
Section Eighteen — General Provisions
Severability. If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest will stay in full force.
Survival. The provisions that by their nature should survive — including the disclaimers, limitation of liability, indemnification, no-refund policy, and dispute-resolution terms — survive any termination of an Enrollee’s membership or access.
Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between an Enrollee and Bicep Buddies regarding the Journal and supersede any prior understanding on that subject.
Assignment. An Enrollee may not assign their rights under these Terms without prior written consent. Bicep Buddies may assign them freely, including in connection with any transfer of the business operated under its trade name.
No Waiver. A failure to enforce any provision is not a waiver of the right to enforce it later.
Force Majeure. Bicep Buddies is not responsible for any failure or delay caused by events beyond its reasonable control.
